The power to restrict the movement of people to specified timeframes
The Minister for the interior has the power to impose a curfew where he thinks it is in the best interest of the people to do so. This power is limited to only a part of the country and not the whole country. This is provided for under Section 4 of the Public Order Act, 1994 (Act 491).
Section 4—Power to Impose Curfew.
(1) Where the Minister for the Interior considers that it is reasonably required in the interest of
defence, public safety, public health, the running of essential services or the protection of the
rights and freedoms of other persons to impose a curfew in any part of Ghana, he may by
executive instrument impose a curfew in such part only of the country as shall be specified in
the instrument.
The Process of imposing the curfew
- There is a security assessment made by the National Security Council, Regional Security Council or District Security Council. If there are security concerns, the council will then present a report to the Minister for the Interior and advise him on the need to impose a curfew.
- The Minister, issuing an Executive Instrument, officially declares the curfew and specifies the affected areas and curfew hours.
- Subsequently, the Parliament of Ghana is notified of the imposition as soon as practicably possible.
- The police and other security agencies will then enforce the curfew in the affected area and ensure that everyone complies with the order.
- The curfew can only be imposed seven days at a time. After the expiration of the seven days, the imposition of the curfew may be lifted or renewed based on the security situation.
