GAF denies role in Bawku deaths, warns residents against engaging soldiers

The Ghana Armed Forces (GAF) has refuted accusations of involvement in the recent deaths of three individuals in Sabongari, Bawku. This follows the January 12th killing of Issah Halidu, a 40-year-old Mamprusi man, which sparked escalating violence in the area. While acknowledging the rising tensions and tragic loss of life, the GAF firmly denies any involvement in the subsequent deaths. Their statement emphasizes that the assailants responsible for the recent attack were not held in their custody at any point. The violence, according to a statement by GAF began on January 12 with the murder of Issah Halidu, a 40-year-old Mamprusi man. On January 17, unknown gunmen attacked public members, killing two and injuring four others. Again, on January 18, the GAF fired at a Ghanaian Army post and spotted two locals attempting to light a Rocket Propelled Grenade (RPG) bomb at a Goil Filling Station in Bawku. The GAF has expressed regret over the deaths but warns against direct engagement with military personnel. “It is instructive to note that directly engaging the military is a development that could result in fatal consequences as troops will spare no opportunity to defend themselves as well as protect residents of Bawku. Therefore, factions in the Bawku conflict are cautioned against drawing the military into direct armed confrontation while efforts are undertaken to resolve the current impasse.” Citinewsroom

Attempted Kidnapping of JK Horgle & Daughter – Driver sentenced to 8 years

Accra, Jan. 20, GNA - An Accra Circuit Court has sentenced a driver to eight years imprisonment in hard labour for attempting to kidnap a father and daughter for ransom. Godfred Ayittey denied conspiring with Wang Liang in preparation to kidnap the two for ransom, but after trial, he was found culpable. Wang is currently at large. Deputy Superintendent of Police (DSP) Emmanuel Nyamekye earlier told the Court presided over by Mrs Afia Owusua Appiah that on August 3, 2022, one Richard Asomaning, a witness in the case reported to Tema Police that Ayittey, now convict, recruited him on phone to engage in kidnapping and same asked that Asomaning (witness) recruited a competent driver for them to undertake such an operation for a ransom. DSP Nyamekye said the witness feigned interest in the act and forwarded copies of his driver’s license and Ghana card as well as that of one Peter Ofoe Agbovie, a friend to the first witness, who he had just recruited for the convict. The witnesses then requested a meeting with the convict to know, who their victim or victims were, he told the Court. The prosecution said the convict mentioned the victims to the witnesses as Mr Joseph K. Horgle, the owner of J. K. Horgle Transport and Company Limited at Kpone and his daughter Elinam, who is also the Deputy Managing Director of the same company. Ayittey never met the witnesses in-person, he only communicated with them on phone. The Court heard that Ayittey, the convict provided fifty Ghana cedis (GHC50.00) to Asomaning to commence surveillance on either of the victims and initial photographs of the company’s premises were taken and sent to the convict. Agbovie, DSP Nyamekye said was asked by the convict to rent a vehicle, whilst he (convict) procured guns for the operation. The prosecution said the convict was tracked and arrested on August 09, 2022, and same admitted to the offence and indicated that one Wang, a Chinese he worked with at DADA Foods engineered the kidnapping. Investigations revealed that the convict had worked at the intended victim’s Company from 2017 to 2018 as a driver and knew the former boss had the financial muscle to pay any ransom using Crypto currency to Wang LIANG’s account in China to avoid detection. He said Asomaning had earlier posted his particulars, including his phone number on jiji online seeking job as a driver. The accused person picked the first witness’ phone number from the site and contacted him for the job as a driver and when he agreed, he changed the topic from employment to kidnapping. Xavier Sosu proposes legislation to substitute community Service for minor offence penalties

The Member of Parliament (MP) for Madina, Francis-Xavier Sosu, has put forward a new bill in Parliament aimed at amending the Criminal and Other Offences (Procedure) Act, 1960 (Act 30). The proposed amendments introduce community service and a Bond of Good Behaviour as alternatives to conventional custodial sentences and fines, particularly for minor offences. Mr Sosu presented the bill on Wednesday, December 20, 2023, seeking to bring about a shift in the approach to sentencing for certain offences. Community service, within the realm of criminal justice, entails an alternative form of punishment where individuals who have committed offences engage in unpaid work or service that benefits the community. This can encompass activities such as cleaning public spaces, participating in environmental projects, contributing to community centres, assisting with social services, or engaging in other projects that enhance the overall well-being of the community. Conversely, a Bond of Good Behaviour typically involves a court-ordered condition imposed on individuals engaged in criminal activity. It forms part of a sentence and is designed to ensure lawful and responsible behaviour over a specified period. In a statement regarding the proposed amendment, the MP emphasized that the introduction of community service or the Bond of Good Behaviour provides offenders with an opportunity to contribute their time and efforts to community-oriented projects or organizations. This approach aims to address the consequences of their actions, foster rehabilitation, and enhance community well-being. The MP highlighted the benefits of the proposed alternatives, stating, “In the first place, this proposal provides an alternative to Custodial Sentence and Fines: Community service and Bond of Good behaviour serve as an alternative to traditional forms of punishment, such as imprisonment or payment of fines. “It allows offenders to remain in the community while still being held accountable for their actions.” He further stressed the importance of adapting punishment methods to align with evolving restorative justice principles, stating, “Community service and Bond of Good behaviour are a perfect example of restorative justice where the community turns to benefit directly from offenders.” The proposed amendments seek to introduce a more nuanced and community-centric approach to justice, providing an opportunity for offenders to contribute positively to society while holding them accountable for their actions.   myjoyonline.com

Actor Alec Baldwin Charged again with manslaughter in ‘Rust’ movie-set shooting

Alec Baldwin on Friday was charged again with involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins on the set of the film “Rust,” reinstating a criminal case against the actor months after previous charges were dropped. Friday’s indictment by a New Mexico grand jury followed an independent forensic test concluding that Baldwin, 65, would have had to pull the trigger of a revolver he was using in a rehearsal for it to fire the live round that killed Hutchins. The finding was the same as a previous FBI test on the firearm. Baldwin’s lawyers, Luke Nikas and Alex Spiro, issued a statement on Friday on behalf of their client saying, “We look forward to our day in court.” Baldwin, the Emmy-winning performer who starred in the hit NBC television comedy “30 Rock,” has denied pulling the trigger and said he was not responsible for Hutchins’ death in the Oct. 21, 2021, shooting on the New Mexico movie set near Santa Fe, the state capital. The movie’s director, Joel Souza, was hit and wounded by the same bullet that killed Hutchins. According to a police report, David Halls, the assistant director who handed the gun to Baldwin, told the actor the weapon was “cold,” an industry term meaning it did not contain live ammunition or even blank rounds. Special prosecutor Kari Morrissey previously said she would file new charges against Baldwin if the independent test showed the reproduction long Colt .45 revolver was in “working condition.” Prosecutors previously dismissed charges against Baldwin based on evidence the hammer of the revolver might been modified, allowing it to fire without the trigger being pulled. The single-page indictment filed with the First Judicial District Court in Santa Fe charges Baldwin with involuntary manslaughter under two alternative legal definitions – causing a death by “negligent use of a firearm” and by acting “without due caution or circumspection.” Should the case go to court, it would be up to a jury to decide whether Baldwin could be found guilty by either one definition or the other. Involuntary manslaughter is classified in New Mexico as a fourth-degree felony punishable by up to 18 months in prison. Baldwin was similarly charged with involuntary manslaughter in January via a criminal complaint filed by prosecutors. Those charges were dismissed in April. A grand jury indictment allows prosecutors to avoid the additional legal step of convincing a judge during an evidentiary hearing that there is probable cause to proceed to trial. The movie’s chief armorer, Hannah Gutierrez, who handled the gun before Halls, was also charged with involuntary manslaughter. She faces a 2024 trial. Halls signed a plea agreement for the charge of negligent use of a deadly weapon. “Our clients have always sought the truth about what happened on the day that Halyna Hutchins was tragically shot and killed,” attorney Gloria Allred, who is representing Hutchins’ parents, Olga Solovey and Anatolii Androsovych, said in a statement on Friday. “They continue to seek the truth in our civil lawsuit for them, and they also would like there to be accountability in the criminal justice system,” Allred added. Sexual Assault Charge – I Was Drunk says Dani Alves

Former Brazil international Dani Alves said for the first time that he was drunk on the night he is accused of committing sexual assault, judicial sources have confirmed to news agency EFE. If accepted as a mitigating factor when the case goes to court in February, it could lead to a reduced sentence in the case of a conviction. Alves’ lawyer, Inés Guardiola, has argued that the level of Alves’ intoxication impaired his cognitive ability and left him unaware of his actions. It is the fifth time Alves has changed his story since he was arrested last January on charges of sexually assaulting a woman in a nightclub in Barcelona on December 30, 2022. At first, he maintained he did not know the victim. He later said that he had met the woman in the bathroom of the club but that nothing happened. The former Barcelona and Paris Saint-Germain defender, when shown biological evidence, changed his version of events, saying she had consensually performed oral sex on him. Last April, after the results of further biological tests, Alves said for the first time that he had sex with the woman, saying that it was consensual and that he had lied to hide his infidelity from his wife. Alves, 40, has been in preventative prison without bail since his arrest one year ago. His contract with Liga MX club Pumas UNAM, the club he joined after leaving Barça in June 2022, was terminated after he was detained. He will stand trial February 5-7 at a court in Barcelona. State prosecutors are seeking a nine-year prison sentence. The lawyers representing the woman want him to spend 12 years behind bars. They also seek restraining orders for Alves after the jail term and for him to pay damages worth €150,000 ($163,605) to the woman.

Gregory Afoko: New Jury Ready For 3rd Trial

A new seven-member jury has been empaneled to hear the case of Gregory Afoko who is accused of murdering the New Patriotic Party’s (NPP) Upper East Regional Chairman, Adams Mahama in 2015. The accused yesterday pleaded not guilty – the third time he is doing so to one count of murder and one count of conspiracy to commit murder. His co-accused, Asabke Alangdi, who was found guilty and sentenced to life imprisonment for conspiracy to murder, also pleaded not guilty to murder yesterday. This is the third time in about nine years that Afoko is standing trial for the murder of Mr. Adams in 2015, after acid was poured on him in the middle of the night upon returning home. The new seven-member jury to decide the case comprises four men and three women. Three prospective jurors were rejected in the lead up to empaneling of the seven. Justice Marie-Louise Simmons, the trial judge, adjourned the case to February 2, 2024, for Case Management Conference and for the prosecution as well as the defence teams to address the jury. The prosecution is expected to call its first witness on February 26, 2024, if pretrial processes have been disposed of. Marina Appiah Opare, a Chief State Attorney at the Office of the Attorney General, indicated that the prosecution would be relying on all their 16 previous witnesses as well as all processes pertaining to the case. This is the third time Afoko is facing trial for the offence of allegedly killing Adams Mahama in 2015. The first trial was truncated by the Office of the Attorney General following the arrest of Afoko’s alleged accomplice, Asabke Alangdi, who fled the country after the incident in May 2015. The second trial ended on April 27, 2023, with a seven-member jury presenting a verdict that shocked many. The jury by a 4:3 decision found Gregory Afoko not guilty of conspiring to murder the late Mr. Mahama, but unanimously found his co-accused, Asabke Alangdi guilty of the same offence. The jury, however, by a 4:3 decision found the two accused persons not guilty of the substantive charge of murder, thereby resulting in a hung jury and a retrial by a different jury. While Afoko is to be retried as a result of a hung jury, Asabke Alangdi was sentenced to death by hanging after he was convicted by the court based on the jury’s guilty verdict on the charge of conspiracy to commit murder. Part of the prosecution’s facts state that the deceased returned home around 11:10pm in his pick-up vehicle, with registration number NR 761 – 14, and immediately he parked the vehicle in front of his house, the suspects went close and signalled him to roll down the glass. The deceased identified the suspects to be party members and rolled down the glass to talk to them. Suddenly, the suspects poured the substance suspected to be acid on his head, face and other parts of his body and fled on a motorbike. “The deceased started screaming for help and his wife, Hajia Zenabu Adams, went to his aid and managed to bring him out of the vehicle,” the prosecution added. The facts state that Mr. Mahama’s wife also sustained burns on the right side of her chest and breast while assisting her husband. DGN-Gibril Abdul Razak
