ENTRANCE EXAMINATION FOR ENTRY TO THE
GHANA SCHOOL OF LAW 2023

DATE: FRIDAY, 8™ SEPTEMBER 2023

TIME ALLOWED:  NINETY (90) MINUTES (12:OONOON – 1:30PM)

INSTRUCTIONS TO CANDIDATES:

  • Read the instructions very carefully before beginning your answers,
  • ANSWER BOTH QUESTIONS – QUESTION ONE IN THE PINK ANSWER BOOKLET AND QUESTION TWO IN THE YELLOW BOOKLET.
  • Credit will be given for legible handwriting, clarity of expression and orderly presentation of answers.
  • Do not write or sign your name on the Answer Booklets. Only write your index number.
  • Adhere strictly to the instructions on the front cover of your Answer Booklet.

QUESTION 1

Discuss five (5) major ways in which the Land Act, 2020 (Act 1036) departs from the land law of Ghana immediately preceding the coming into force of the Act.

QUESTION 2

Kweku Ntoso and Kofi Babo are colleagues at work. They work in the Mining Department of the Ministry of Natural Resources. Recently, they competed for the Position of Head of Department. Mr. Ntoso has just heard that Mr Babo was offered the position and is very upset. He met Mr. Babo in the corridor a few minutes later and whispered the following words harshly and menacingly, whilst waving his clenched right fist:

“We shall see in this Department.”

At lunchtime, Mr. Ntoso picked up his tray of food in the departmental cafeteria and shoved Mr. Babo with his shoulder as he walked to take his seat, muttering the same statement he made to Mr. Babo earlier. At close of work, Mr. Ntoso grazed the side of Mr. Babo’s saloon car with his heavy-duty cross-country vehicle when he drove out of the car park. That same evening, Mr. Ntoso placed the following message on one of the social media platforms of the Department: “We all know that he is not qualified, is incompetent and only got the job because he is a cousin to the Minister.”

Mr. Babo is very upset with all of these actions of Mr. Ntoso and has come to you for advice. He has indicated that he would not want to make an internal complaint at the Department or the Ministry, since he would place his cousin the Minister in an awkward position. For the same and other reasons, he does not want to file a criminal complaint.

He wants, in his own words, for “Mr. Ntoso to stop doing all these things against me and to pay compensation to me for the harm caused.”
