On the 16th January, 1961, the Supreme Court (van Lare, Granville Sharp and Akiwumi, JJ.S. C.) set aside the decision of Adumua -Bossman, J. in the High Court (Lands Division) Cape Coast, reported at [1959] G.L.R. 44. The questions of law involved in this case were not discussed, as the Supreme
Court did no more than state that:
“the order made on the 10th November, 1960, by consent of the parties in this case is to stand and
constitutes the final order of this court with the added order that the respondent do forthwith deliver up
possession to the appellant of all the farms referred to in the fore mentioned order.”
[p.60] of [1961] GLR 59
The said order of the 10th November, 1960 was in the following terms:
“The parties further agree to a declaration that the sales of the lands in dispute are invalid, the farms are
therefore declared to be the properties of the family of which the appellant is the present head. The parties consent to the following terms: -The total purchase price of £G232 3s. paid by the respondent in respect of the farms to be refunded by the appellant together with expenditure incurred by the respondent in development and improvements of the said farms, this latter figure to be assessed upon a survey by an agricultural officer appointed by the parties.
“The respondent is to account for all cocoa collected or sold from present date.”
